Employee Misconduct & Breach of Environmental Law

A whistle-blower at a major construction company notified the Board of serious employee misconduct occurring across a remote project site. Allegations included drug use, the sale of alcohol, assault, bullying and harassment (including sexual harassment), as well as the unlawful dumping of waste in breach of environmental regulations.
A CurbyMcLintock Partner was appointed to lead an independent investigation, reporting to two separate law firms, one overseeing employment-related matters and the other responsible for the environmental law aspects of the engagement. The investigation involved extensive interviews with witnesses, including employees and external contractors, followed by formal interviews with three respondents implicated in the allegations.
The evidence gathered enabled the client to engage constructively with the relevant environmental regulator and make informed decisions regarding disciplinary action against staff involved in the misconduct. The investigation also provided clarity around systemic issues contributing to the behaviour, supporting broader organisational decision-making.
